Pilipuka Agent is a free, AI-powered tool designed for use by licensed legal professionals to analyze court records for expungement eligibility under Hawaiʻi law. The Service is a project of NHLC and is powered by Anthropic's Claude AI technology through a commercial enterprise API subscription.
2. Information We Collect
2.1 Information You Provide
The primary information processed through Pilipuka Agent consists of court record documents that you upload for analysis. These documents are PDF files obtained from the Hawaiʻi State Judiciary's eCourt Kōkua system, which is a publicly accessible database. The information contained in these records — including names, case numbers, charges, and dispositions — is public record.
We do not require you to create an account to use the Service. We do not collect or request the following: Social Security numbers, financial account information, login credentials, health records, or other sensitive personal data beyond what is contained in publicly available court records.
2.2 Information Collected Automatically
When you visit the Pilipuka website, we may automatically collect limited technical information, including IP address, browser type and version, device type, pages visited, and date and time of access. This information is collected through standard web server logs and is used solely to maintain and improve the Service.
2.3 Cookies
The Pilipuka website may use cookies or similar technologies strictly for site functionality and performance. We do not use cookies for advertising, tracking, or profiling purposes. You may configure your browser to decline cookies, though this may affect site functionality.
3. How We Use Information
We use the information described above for the following purposes:

4. AI Technology and Data Processing by Anthropic
4.1 How AI Processing Works
When you upload court record documents to Pilipuka Agent, those documents are transmitted to Anthropic's Claude AI through a commercial enterprise API for analysis. Anthropic processes the documents to generate an expungement eligibility assessment, which is then returned to you through the Service.
4.2 No AI Model Training
NHLC's enterprise API subscription with Anthropic operates under Anthropic's Commercial Terms of Service. Under those terms, Anthropic does not use any inputs submitted through the Service — including uploaded court records, prompts, or outputs — to train its AI models. This prohibition on training use applies by default to all commercial and enterprise API customers and is not subject to an opt-in or opt-out toggle.
4.3 Data Retention by Anthropic
Under NHLC's commercial arrangement with Anthropic, data submitted through the API is subject to a 30-day retention period. After 30 days, inputs and outputs are automatically deleted from Anthropic's systems. In limited circumstances, if a submission is flagged by Anthropic's automated trust and safety classifiers as potentially violating Anthropic's Usage Policy, Anthropic may retain that data for a longer period as described in Anthropic's Privacy Policy.
4.4 No File Retention by the Service
The Pilipuka website does not store uploaded files after your web session ends. Once you close or navigate away from the Service, any documents you provided are no longer retained by the website.
4.5 Anthropic's Privacy and Security Practices
Anthropic acts as a data processor on behalf of NHLC when processing data submitted through the Service. Anthropic's data handling is governed by its Commercial Terms of Service and its Data Processing Addendum, which incorporates Standard Contractual Clauses for international data transfers. 5. Data Processed by NHLC
NHLC maintains access to use logs generated through its enterprise API subscription with Anthropic, consistent with the access available to Anthropic commercial customers. NHLC holds all information contained in these logs in confidence and uses them only for purposes of maintaining and improving the Service, monitoring for misuse, and complying with legal obligations. These logs are retained in accordance with NHLC's internal data retention policies and applicable law.
6. Data Security
We take reasonable administrative, technical, and organizational measures to protect the information processed through the Service. These measures include encryption of data in transit, access controls for NHLC personnel, and reliance on Anthropic's enterprise-grade security infrastructure. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
7. Public Nature of Court Records
All court record information that users are authorized to submit to Pilipuka Agent is publicly available through the Hawaiʻi State Judiciary's eCourt Kōkua system. The Service does not collect, request, or process non-public personal information beyond what is contained in these publicly accessible records.

The Service may contain links to third-party websites, including the Hawaiʻi State Judiciary, the Attorney General's Office, and Anthropic. We are not responsible for the privacy practices of these external sites. We encourage you to review the privacy policies of any third-party sites you visit.
9. Children's Privacy
The Service is designed for use by licensed legal professionals and is not directed at individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected such information, we will take steps to delete it promptly.

10.1 General Rights

Because the Service processes only publicly available court records and does not retain user data beyond sessions, these rights are generally satisfied by the design of the Service. 10.4 Rights Under the General Data Protection Regulation (GDPR)

The lawful basis for processing data through the Service is your consent, provided when you voluntarily upload documents for analysis.
